EULA - End User License Agreement

READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS SOFTWARE. USE OF THE SOFTWARE INDICATES YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE WITH THE FOLLOWING, DO NOT INSTALL, COPY, OR USE THE SOFTWARE AND REMOVE IT FROM YOUR STORAGES.
Terms and Conditions
In this license agreement (License Agreement), you, the purchaser of the license rights granted by this License Agreement, are referred to as Licensee. Ranorex GmbH (Licensor) grants you a non-exclusive, non-transferable license to use one copy of the associated computer program (Software) subject to the terms and conditions of this License Agreement. The Software is licensed, not sold.

Licensor grants the Licensee right to use the Software for the automation and testing purposes.
Restrictions

Licensee may not resell, rent, lease or distribute any components or files provided with the Ranorex package. For this you need to purchase a Ranorex Embedded License from the manufacturer.

In no case may the license key file be distributed. The licensee is to store the license keys and files supplied by the licensor in a safe place. The licensor is not responsible for lost license keys or files.

The licensee is required to hold the license keys and files secure. The licensee will be held responsible for any unauthorized use of the license keys or files.

The licensee agrees not to attempt to bypass the license mechanism or generate unauthorized license keys or files.

Save to the extent expressly permitted by this License Agreement or mandatory provisions of law, Licensee shall not modify, translate, reverse engineer, decompile or disassemble the Software or any part thereof.

Licensee acknowledges that the Software cannot be guaranteed error-free and further acknowledges that with due consideration of the license fee and the nature of the Software it has not relied on errors being corrected should the Software prove defective.
Types of License:
Free License:

The Licensor grants you a non-exclusive, non-transferable license to use one copy of the associated computer program.

You may use the free version of Ranorex for personal and educational use but NOT for commercial use. For commercial use, you need to buy one of the following licenses.
Single Developer License:

The Licensor grants you a non-exclusive, non-transferable license to use one copy of the associated computer program on a single computer. If the program is used on more computers or simultaneously by several people in a network, you must purchase a site or multi-site license.

The license fee includes only one version of the Software.
Single Developer License with 12 month priority support:

The Licensor grants you a non-exclusive, non-transferable license to use one copy of the associated computer program on a single computer. If the program is used on more computers or simultaneously by several people in a network, you must purchase a site or multi-site license.
The license fee includes upgrades and new versions of the software for 12 month from the date of the purchase.

Your support requests will be given priority over other customers who are using standard support.
Site License:

A Site License refers to one geographic location or to multiple sites within one city that are part of a single organization unit administered centrally. The license fee includes upgrades and new versions of the software for 12 month from the date of the purchase.

Your support requests will be given priority over other customers who are using standard support.
Multi-Site License:

A Multi-Site License refers to an organization in more than one city, state, or country, with administration of this license being done centrally on behalf of all locations. The license fee includes upgrades and new versions of the software for 12 month from the date of the purchase.

Copyrights, Trademarks
The Software is protected by copyright and other intellectual property laws and treaties. Save for the right to use as herein expressly granted, all rights in and to the Software are reserved by the Licensor or its proprietors. Licensee shall not remove or destroy any proprietary, trademark or copyright markings or notices placed upon or contained within the Software or any related materials or documentation. Licensee shall not, by reason of this License Agreement or the performance hereof, acquire rights of any kind in any trademark, trade name, logo or product designation under which the Software was or is marketed and Licensee shall not make any use of the same for any reason.
Updates
The features in the Software may change when upgrades are made. The Licensor tries to maintain backward compatibility but makes no guarantees to do so. If the Software is an upgrade or update to a privious version of the Software, you must possess a valid license to such previous version in order to use such upgrade or update. All upgrades and updates are provided on a license exchange basis.
Support

Support related to general Software functionality and issues is available through email or the Ranorex Forum.

It is only possible to handle requests which are using the form you can find on the support page on our website. Before transmitting your support request please read our hints. Probably you will be able to find a solution to your problem and you don't need to contact us. Very important is that you indicate the correct version of the software and the used programming language.
Termination
Licensor may terminate this License Agreement if Licensee breaches any of the terms and conditions. In the event of such termination and upon expiry of the lecense granted herein, Licensee will delete the Software from any files and data storage. All provisions of this License Agreement relating to disclaimer of warranties, limitations of liability, remedies, or damages, and Licensors proprietary rights shall survive termination.
Limited Warranty
IT IS EXPRESSLY UNDERSTOOD BY LICENSEE, THAT THE SOFTWARE IS PROVIDED AS IS WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER ORAL OR WRITTEN (INCLUDING BUT NOT LIMITED TO THOSE RELATING TO NON-INFRINGEMENT, SATISFACTORY QUALITY, FITNESS FOR PURPOSE OR MERCHANTABILITY) TO THE FULLEST EXTENT ALLOWED UNDER APPLICABLE LAW.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LOW, IN NO EVENT WILL LICENSOR BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO THIS AGREEMENT OR USE OF THE SOFTWARE, INCLUDING BUT NOT LIMITED TO LOST PROFITS, BUSINESS INTERRUPTION OR LOSS OF INFORMATION OR CORRUPTION OF DATABASES, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF WHETHER ANY ACTION OR CLAIM IS BASED ON WARRANTY, CONTRACT, TORT OR OTHERWISE. UNDER NO CIRCUMSTANCES SHALL LICENSORS TOTAL LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT EXCEED THE TOTAL AMOUNT PAID BY LICENSEE TO LICENSOR.
Applicable Law

This License Agreement is governed by the laws of Austria.

In respect of any dispute which may arise hereunder, you agree to be bound by the court in Graz, Austria.
